Coolidge Pays $145,000 to Resolve Sundance III Water-Supply Error

COOLIDGE, AZ — The City of Coolidge will contribute $145,000 toward a 100-year water supply certificate for the Sundance III subdivision. The payment resolves a dispute over plat approvals that incorrectly indicated the property already had assured water. Developer Arik’s Custom Homes, LLC is paying $193,580 toward the same certificate. The City Council unanimously approved the Sundance III settlement agreement during its April 27, 2026 regular meeting. The deal completes the funding for the certificate the 38-lot residential project needs.

On August 15, 2005, the City approved the original Sundance Coolidge III final plat. That plat included a note indicating a 100-year assured water supply.

On September 9, 2019, the City approved a replat called Orlando Estates, which also indicated a 100-year assured water supply. However, the property did not actually hold that designation at the time of either approval. The developer had not obtained the required assurance from Arizona Water Company before acquiring the subdivision.

Without an actual assured water supply designation, the subdivision could not move forward and remained undeveloped for nearly twenty years. Arik’s Custom Homes, LLC raised claims against the City over the plat approvals.

What the Sundance III Settlement Means for Residents

Development still depends on Arizona Water Company issuing the 100-year water supply certificate. The developer paid $193,580 toward the certificate on April 21, 2026. The agenda summary characterizes the city’s contribution as covering approximately one-half of the required water infrastructure or acquisition costs.

The certificate will attach to and run with the land. Therefore, it will transfer to any subsequent owner of the property.
